Thanks for the patch, I applied and the compile went fine, I'm using 
The linux-2.4.20-gentoo-r5 kernel at the moment.

Unfortunately I ended up confusing myself hopelessly installing it into
the kernel, so I've used oss for now. 

I'll check back when it starts appearing in portage.
