It's supposed to work. Are both the CVS server and the CVS client patched?
I think I duplicated this problem with an patched client + unpatched server.
But, when both were patched, it's working ok for me...
If both yours are patched (or if you're using local mode),
then I will have to dig into it in more detail.
BTW, thanks for trying the patch and for reporting this.
