I expect you're "checking out" into an existing directory, which means
you're really doing an update.  If you do a fresh checkout into a new
directory, you won't have the problem.  Alternatively, you can fix the
problem in the existing directory by editing the CVS/Entries file and
removing the line referring to the defunct directory.
