Also, why doesn't it help to set
\override Score.RehearsalMark #'no-spacing-rods = ##t
to make the first example behave like the second one?

I don't know about this myself. I can add this as a bug, if you have examples of good hand-engraved scores that do this (or if people in general support your claim).
