The warning is still relevant, since the position of the notes that are printed are still affected by the invisible note.
I don't understand that claim. If the position was affected the notes would not have clashed, would they? That's what the explicit \oneVoice is for - to get the notes into the exact same location. I thought that is the "standard" way to merge and split voices (though I notice now that tie-cross-voice.ly was removed from the Tips and Tricks section of the docs in version 2.4. Is this intentional?) Anyway, removing the hidden note voice in this example (with or without removing the "\\") has no effect on the position of the other voice.
