MORE US STATES IMPLEMENT "SUPER" DMCA

Edward Felton's "Freedom To Tinker" website reports that legislation is
being considered in around eight US states that Felton claims could
manipulate the DMCA, making it possible that any technology that "conceals
the existence or place of origin or destination of any communication" could
be considered illegal depending on the wording of the bills. The Motion
Picture Association of America (MPAA) is heavily promoting the super-DMCA
and has been circulating a brief document called, "Why State Legislation is
Needed to Combat Broadband and Communications Piracy", which explains the
pros of such legislation. Michigan has already passed such legislation and
bills are "pending" in Arkansas, Colorado, Florida, Georgia, Massachusetts,
South Carolina and Texas. Critics of the new broader versions of the DMCA
claim that they are even more restrictive, disallowing exemptions for
reverse engineering, for encryption research and for librarians. Several
library associations have complained, stating "While digital piracy is a
serious problem, some of the proposed amendments will undermine the ability
of libraries to provide important information services."
