I cannot reproduce this. Here are the steps I took.
- clocked into a headline
- clocked out
- switched buffer to *scratch* (I tried it a second time with a TeX
buffer, which also worked)
- typed C-u M-x org-clock-in
- selected 1 (the most recent task)
Org successfully clocked into the task in the background.
