Linus Torvalds can't assign the kernel to the FSF. He doesn't own complete 
copyright to (all works comprising) the kernel. He can probably assign his 
own copyright in the kernel, but that covers pretty small part of the 
kernel plus overall compilation work [see 17 USC 101] of his own. That's 
not complete copyright to (all works comprising) the kernel.

Moglen said (and lied) that 

"It is well known that the Free Software Foundation does not hold
 copyright in the Linux system kernel program. "
