Because it is a copy on the way to a CD.

But rechristening the archival CD afterwards as something you can sell
separately is not going to fly well with the courts.

You really seem to be of the opinion that courts are supposed to enjoy
mincing words.  But it is their purpose to deliver justice, not
wordplay.
