   Not being able to enforce non-freedom by the way of the law would
   be quite a big step forward.  Of course, this would leave technical
   measures.  The easiest being omitting the source code...

Or Treacherous Computing/Digital Restriction Managment, which is one
of the nicest things the GPLv3 draft touches upon.

   I consider it likely that the overall benefits would be worth
   losing both restrictions and protection possible by copyright.

While what you say is true, I wouldn't be willing to put my neck for
it.  I'd rather have a way to defend my freedom, then not having the
means.
