Using his exclusive rights to authorize, the rights holder simply states conditions that must be met for authorization to be granted.
 If those conditions are not met, permission is not granted.

Perfect example of a condition!

unless its non-occurrence is excused, before performance under a
contract becomes due.

Prithee Hyman, tell us what conditions stated in the GPL must occur
*before* performance (copyright permissions) become due.
