If I understand your problem (which you never quite managed to state
unequivocably), you have a file in the Attic which is alive on the
trunk.  You are correct that that should not happen.  There is a known
bug in CVS that can cause that -- if you add a file to the trunk (either
from a branch or by resurrecting a previously dead file) and don't
immediately commit it, a subsequent update will cause CVS to forget that
the file needs to be moved out of the Attic.  The simplest fix is to
just manually move the repository file out of the Attic.
