It would appear that CVSROOT/config may have TopLevelAdmin=yes set:
# Set `TopLevelAdmin' to `yes' to create a CVS directory at the top
# level of the new working directory when using the `cvs checkout'
# command.
TopLevelAdmin=yes
It is one of the administrative options open to any cvs repository
administrator.
