If this problem occurs on a Windows client with an update (not a fresh
checkout) then the problem is that the CVS/Entries file has an entry
foo.GIF, and CVS will keep that case.

What version of the client and server are you running?

In future, you can simply rename the ,v file in the repository, instead
of deleting it and re-creating it.
