Correction: Added second half of document. He provided a declaration for IBM stating that SCO's allegations aren't true. Patricia Dunn and Larry Sonsini are answering questions now. And SCO worked hard to make Linux POSIX compliant because they wanted Linux to have Unix capabilities for the enterprise.
Emerson and I discussed a variety of investment structures wherein Microsoft would 'backstop,' or guarantee in some way, BayStar's investment. It's available to the public. So we'll do it together.
A lot of folks have done so too, and so IBM is now asking the court to toss out these three SCO claims. He provided a declaration for IBM stating that SCO's allegations aren't true. There's no legal notice that this is only for SCO customers or any nonsense like that. I'm wondering now if Mr.
SCO was keeping them on artificial respiration anyhow, despite there being no brain wave activity. SCO knew what was in there with specificity, he testifies, and released under the GPL knowingly.
Here's a piece they might not know. Emerson and I discussed a variety of investment structures wherein Microsoft would 'backstop,' or guarantee in some way, BayStar's investment. End game is turning out to be fun.
Another secret in SCO's mountain of secret offenses for which they would like IBM to pay them billions. But let's let Goldfarb tell his own story and I'll get the PDF up as soon as I can.
It can't be, I thought.
BayStar denies it, as does IBM. I worked there and that was my job, to implement that wish.
One can't help but ask.
If summary judgment is denied, Novell requests in the alternative that this Court issue a preliminary injunction requiring an accounting and establishing a constructive trust. Then in the alternative, they have a menu of other smaller delays.

A lot of folks have done so too, and so IBM is now asking the court to toss out these three SCO claims. For example, IPX was contributed to Linux by SCO. I know you join me in thanking Mark for writing this for us.
Boies will end up a witness in this case, if IBM's motion is denied and SCO gets to proceed with its interference claims. If you have additional questions or subjects you'd like explained, this is your opportunity to put in your requests.
Then in the alternative, they have a menu of other smaller delays.
Microsoft assured me that it would in some way guarantee BayStar's investment in SCO. So we'll do it together.
