I disagree -- here is my correction of the uppermost tie (done manually 
in a graphics program):

Note that the tie is exactly the same height as the lower two (in fact, 
I simply duplicated the third tie!), and yet it does not merge with the 
staff line. Furthermore, this "corrected" tie could be scaled down a 
tiny bit in Lilypond to avoid even the 'proximity blur' that one's eyes 
might add automatically in such cases (I just didn't know how to do 
that in Graphic Convertor).

[n.b. I left the second tie (counting from the top) uncorrected, for 
comparison purposes.]
