Follow-up Comment #1, bug #34359 (project octave):
This seems to be the documented behavior. See
http://www.mathworks.com/help/techdoc/ref/patch.html.
In particular, this quoted section
"Unlike high-level area creation functions, such as fill or area, patch does
not check the settings of the figure and axes NextPlot properties. It simply
adds the patch object to the current axes."
I verified that fill() does replace the existing plot.
