Your reasoning is clear enough. Part of the issue at hand can be simply that "gray" shouldn't open a graphics window by itself in the first place. But the issue is equally valid if "gray" works on an existing figure. I tend to think that the OP's problem is primarily that Octave has a pager that is on by default, which complicates the situation for unwary users. Yet the bug you (Dan) describe looks real and is merely uncovered by the obvious reaction of users unwary of the pager's interference.
