What version are you using?
That's not a problem with this release:

  ftp://ftp.gnu.org/gnu/fileutils/fileutils-4.1.tar.gz

Here's what I get, now:

  $ chgrp cdrom /
  chgrp: changing group of `/': Operation not permitted
  [Exit 1]
