It isn't.  You are just blowing your usual smokescreen.  It is about
contracts and whether they can be considered accepted or not by the
download of software.  But the GPL is not a contract.  It is a
unilateral license granting additional rights.  The recipient is not
required to accept it.  But without accepting it, he does not have the
right to make copies for redistribution.
