The GPL is not enforceable anyway, since the recipient of the software
is not required to accept it.  If he doesn't, however, he is back at
square one: normal copyright permissions.  And what SCO did with the
code of IBM is most certainly not legal without some contract or
permission.  If they consider the GPL not a valid permission, then
they'd better have a very good idea just why the code of IBM is free
for them to take and redistribute.
