Actually the copyright owners are suing. SFLC is representing them in
court.

Right. The copyright owner need not mention the GPL. He just alleges
infringement. The only way that the GPL can come into it is if Monsoon
raises it as a defense.

Monsoon is not being asked to distribute. On the contrary, they are being
told to _cease_ distributing.
