Motion of Robert Jacobsen for Costs
 Considering the value of this Court's decision as a seminal
case in copyright law and open source law, Jacobsen believes that the
Court should, in its discretion, award costs to him for bringing the
appeal. A bill of costs for under $1000 is attached.

This is how much the Court of Appeals for the Federal Circuit,
in its own words (sitting en banc), values its own copyright
decisions:

"The freedom of the district courts to follow the guidance of their
particular circuits in all but the substantive law fields assigned
exclusively to this court is recognized in the foregoing opinions and
in this case."; ATARI, INC., v. JS & A GROUP, INC., 747 F.2d 1422, 223
USPQ 1074 (Fed. Cir. 1984) (en banc).

So much for the CAFC's stare decisis (controlling authority).
Ha ha, he he, ho ho.
