No. The complaint
<http://www.softwarefreedom.org/resources/2009/busybox-complaint-2009-12-14.pdf>
alleges that defendants are infringing upon the copyright
of "BusyBox", not of some particular version. There is no
point in lying about this, since the complaint is there to
be read. You may disagree with the validity of the complaint,
but it is useless to deny that the complaint says what it
says.
