I read "Count VIII" here, so let us look at the other counts:
COUNT I
(Federal Trademark Infringement)
COUNT II
(Federal Unfair Competition: False Designation)
COUNT III
(Violation of Federal Trademark Dilution Statute)
COUNT IV
(Common Law Trademark Infringement)
COUNT V
(Breach of Contract) [not the GPL, but rather a trade agreement]
COUNT VI
(Unjust Enrichment)
COUNT VII
(Quantum Meruit)
Count VIII
Breach of Contract (GPL License)
Count IX
Violation of M.G.L.c. 93A§11
The relief asks for:
A(iv): Progress/NuSphere violated the GPL License and thus, their rights
under the GPL were automatically terminated.
B Primarily and permanently enjoin
(iii) Progress/Nusphere from copying, modifying, sublicensing or
distributing the MySQL program.
D Award compensatory and _punitive_ damages [...] (punitive damages for
contract violation of a contract without punitive terms?)
I mean, you are pretty much cherry-picking again, aren't you?
