I hope the Supreme Court sees it this way, because the Ninth's
interpretation of this in Omega v. Costco is horrible. They must
have been drunk or crazy. The Solicitor General of the U.S. filed
a brief opposing granting certiorari, by the way (i.e., wanted
the Ninth's ruling to be left standing).
