It sounds like the file is being added on a branch. 
CVS will put archives for new branch files into the
Attic.  Is this what's happening in your situation?

Also, I think prevention of "cvs rm" is a bad idea
since "removing" files is one of the tasks of a
developer.  It would be better if you could prevent
direct access to the repo (eg via SSH).
