commit cannot Lock issue

Hi
A developer created a file say typedef.Image, then removed it
and recreated a new file with different case Typedef.Image
and when he try to commit this new file he gets an error like
cvs server: cannot lock `path to filename/Attic/Typedef.Image,v'
Since this is a new file there is no admin lock on this file.
I have tried removing this from cvs and re-adding/commiting.
But we Hit the above error repeatedly.
Has someone faced this Error before?
Any help will be greatly appreciated.
