You are quite right, this check should never have been added for LaTeX.

I've removed this check in SVN revision 7906 and uploaded the new 
version to 

http://ftp.gnu.org/gnu/texinfo/texi2dvi

(That file should update in a few minutes.)

Yes, possibly.

It appears not, because the two are not exact parallels.  *.cps must 
always be generated from *.cp but *.aux can exist without bibtex being 
used at all.  I'd missed this point when I introduced this test.
