There is no such thing as an implied license to download anything you
can find on a server (that would be hacker's haven indead!).  Servers
providing software for download pretty much all do so with an
explanation that downloading available software will be pursuant to
the license conditions contained in the downloaded material.

"I found it on some server" does not make you the owner of a copy in
any manner that "I found it on the street" makes you the owner of a
copy of a book.
