Something does not become a "kind of grey area" by somebody wanting it
to be a kind of grey area. Not even if that "somebody" is one with the
power to press charges. Copyright changes ownership (or has joint
ownership) all the time, and the next person might feel different about
enforcing licenses.
And there is nothing fuzzy about the licensing terms of both licenses
and their incompatibility.
