Tear off menus broken

One of the recent patches for NSMenu and family must have broken the 
functionality of tear off menus. It is not that I like them that much, 
but we should not loose them that easily.
How to test this yourself.

1) Open Ink.app
2) Select one sub menu and tear it off.
3) Select "New Document" form the file menu.
4) As soon as the new window apears the tear off menu will vanish.

5) Quit Ink and restart it.
6) The tear off menu will shortly show on the screen. The same happens 
each time the applications is reactivated.
