I don't think "derived work" is the point here.  If SCO were arguing patent 
"protection" then we couldn't rewrite NUMA without infringing on their patent 
- - thus the ideas/mind would be tainted.  The fact that they are arguing 
copyright means that the ideas of NUMA aren't "protecteded".  I also know 
that patents can't cover ideas - but they do in practice :)
